Agreement to terms
These Terms of Service ("Terms") govern your use of Kwagly, operated by KITS ("we", "us", "our"). By creating an account or using Kwagly you agree to be bound by these Terms. If you do not agree, do not use the service.
Your account
- You must provide a valid email address and verify it before using Kwagly.
- You are responsible for keeping your password secure and for all activity that occurs under your account.
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You may not share your account credentials with others.
- Notify us immediately at support@kwagly.com if you suspect unauthorised access to your account.
Acceptable use
You agree not to:
- Use Kwagly for any unlawful purpose or in violation of any applicable law.
- Upload, store, or transmit any student personal data beyond what is necessary for legitimate educational grading purposes.
- Attempt to reverse engineer, decompile, or extract source code from the Kwagly apps.
- Attempt to gain unauthorised access to another user's data or to our systems.
- Use automated scripts or bots to interact with the service.
- Resell or sublicense access to Kwagly.
- Upload malicious files or attempt to disrupt the service.
We reserve the right to suspend or terminate accounts that violate these rules.
Subscription & billing
Free plan
Kwagly offers a free tier with limited monthly usage. Free plan limits may change with reasonable notice.
Pro plan
The Pro plan is available by in-app purchase (via Google Play) or by redeeming a voucher code. The annual plan is a prepaid, non-renewing purchase — it does not auto-renew. At the end of the 12-month period your Pro access expires and you will not be charged again unless you actively purchase a new plan. All purchases are final unless required otherwise by applicable consumer law.
Vouchers
Voucher codes are single-use, non-transferable, and tied to the account that redeems them. Lost or stolen codes cannot be replaced. Vouchers have no cash value.
Refunds
Subscription refunds are handled by the relevant app store (Apple App Store or Google Play) according to their policies. For voucher purchases, contact support@kwagly.com within 7 days of purchase.
Your content
You retain ownership of all content you create in Kwagly — your classes, students, quizzes, and scan results. By using Kwagly you grant us a limited, non-exclusive licence to store and process that content solely to provide the service to you.
You are responsible for ensuring you have the right to enter any student data into Kwagly, and that doing so complies with applicable data protection laws and your school's policies.
Intellectual property
Kwagly, its logo, and all associated software, designs, and documentation are owned by KITS (Kwagly Information Technology Solutions) and protected by copyright and other applicable laws. Nothing in these Terms grants you any right to use our intellectual property except as strictly necessary to use the service.
Availability & changes
We aim to keep Kwagly available at all times but cannot guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice for significant changes that affect paid subscribers.
Termination
You may stop using Kwagly and delete your account at any time via Settings → Danger zone → Delete account. Deletion is immediate and permanent — all your data is wiped.
We may terminate or suspend your account without notice if you violate these Terms or if we are required to do so by law.
Limitation of liability
To the maximum extent permitted by law, Kwagly is provided "as is" without warranties of any kind. We are not liable for:
- Loss of data (always export your results as CSV for backup).
- Inaccurate grading results — always review flagged items before relying on a score.
- Indirect, incidental, or consequential damages arising from your use of the service.
Our total liability to you for any claim arising from these Terms or your use of Kwagly shall not exceed the amount you paid us in the 12 months preceding the claim.
Changes to these terms
We may update these Terms from time to time. Continued use of Kwagly after changes take effect constitutes your acceptance of the revised Terms. We'll notify you of material changes by email or in-app notice.
